[Proposal] [Administrative Bylaw Revisions] Amendment clarification and Under The Gun

Myself, Nicholas Lambaunas, Assistant Head Coordinator and Bruce Lindsay,  Council Member of UTR- Under the Rock; Rockland, NY pursuant to Administrative bylaw 3.A.i  do hereby propose the following amendments to our Administrative Bylaws.

 

With no need for a 2nd, and as proposed by the AHC

 

The tl;dr reason for this proposal is faulty wording on the concept of Amending Proposals.

 

It is unclear, and leaves open a gaping hole that is open to conflicting interpretations.

 

Example -

 

CM Bruce Props an R&U amendment making Nagaraja Coord Notify Today.

 

Coord Nick Proposes that Nagaraja become Extinct the following Day.

Under the Gun Applies. Nick’s Prop can’t open until Bruce’s is Withdrawn, or Closes, unless we agree to let it go.

 

So Bruce decides on day 6 of the discussion, to Amend his prop to make them 2/3s Majority instead. Which resets the discussion period of his prop, and by our current bylaws would also force Nicks prop out another 7 days.   Which can technically be repeated over and over from one point of view, while another interpretation of Under The Gun would lead another to believe an Amendment to the prop is Withdrawing and being proposed again.

 

If you see where I’m going with this, it means you could stall out Under the Gun from the Cue by simply amending your props until the cows come home.

 

This proposal formalizes that an Amendment, is considered a Withdrawn Proposal, and is then reproposed, therefore not allowing for a stalling of the Under the Gun Prop waiting in cue.

 

We are offering an OR where rather than an Amendment be considered a full Withdrawn, it may only be Amended Once, and will still not drop out of the Cue in regards to Under the Gun.

 

It also removes a useless section requiring proposals be submitted to the AHC directly, since the AHCs just get them on the Council list already.

ii. Discussion

  1. Discussion on said [PROPOSAL] shall begin immediately and last for at least a week and the proposal shall be posted on the voting page for record keeping. This week is considered the discussion period.
  2. To suggest a formal change to the proposal, in the subject of the message include [AMENDMENT] and in the body of the message include the description of what is suggested.
  3. The original author of the [PROPOSAL] may accept or reject amendments at their own discretion, if a change is accepted it should be sent to an Assistant Head Coordinator to update the [PROPOSAL] on the website.
  4. Any official amendment to the proposal resets the discussion week allowing for an additional seven days for any objection or second to be applied.

iv. Sneaking in under the gun

  1. If a proposal to add or change R&U or character bylaw restrictions or requirements are made, nothing which would fall under such an addition or change may be created or approved until after such a proposal's closure or withdrawal.
  2. Should a formal Proposal be made to Council and active, subsequent Proposals made to Council and related to the current active Proposal shall be delayed, and queued in order of their being made.
    1. The next related proposal in the queue shall become active and open for its discussion period after the closure, or withdrawal, of the current active Proposal or Proposals discussion period and vote.
    2. The proposer or proposers of currently active related proposals may choose to forgo this delay for the next delayed related proposal, at any time while their proposal is active. They may not skip delayed proposals in the queue.
    3. All such proposers must chose to forgo the delay for another proposal to become active. If only one proposer of related proposals exists, it shall be assumed that they choose to forgo the delay, unless they state otherwise.

5.            Discussion on said [PROPOSAL] shall begin immediately and last for at least a week and the proposal shall be posted on the voting page for record keeping. This week is considered the discussion period.

6.            To suggest a formal change to the proposal, in the subject of the message include [AMENDMENT] and in the body of the message include the description of what is suggested. An Amendment can only be made once and only during the discussion phase of the proposal. Allowing an extension to the proposal for further discussion, potentially extending the proposal for up to a week. Amendments do not hinder the Head Coordinator’s own ability to extend a proposal by their powers. The original author of the [PROPOSAL] may accept or reject amendments at their own discretion, if a change is accepted it should be sent to an Assistant Head Coordinator to update the [PROPOSAL] on the website.

7.            Any official amendment to the proposal resets the discussion week allowing for an additional seven days for any objection or second to be applied.
